Board members for the Pioneer Addition HOA, as well as other neighborhood HOAs, are working on pursuing legal action to have the EMMA declarations declared invalid by the courts.

In order to do this as a neighborhood associations we must satisfy requirements from the neighborhood HOA CC&Rs. The CC&Rs require that a vote be held by the HOA that gets 75% of all homeowners voting in favor of the neighborhood HOA filing the suite.

There are also statutory requirements from the state that must be met.

To that end, if you are a homeowner in the Pioneer Addition HOA and would like to make sure your vote on this matter is counted in the special meeting for this topic, you can sign a proxy vote and get it to a board member or upload it as an action item to the management site for the HOA.
